This will convey the property <br /> interest of a portion of the City owned land to Quinney's in exchange for Quinney's conveyance of a portion of their <br /> property to the City. This is consistent with the terms of the pending exchange agreement dated April 24, 2006 (contract <br /> number 2006-05328)which was prepared and reviewed in cooperation with Parks and Open Space staff and the Jerry <br /> Lidz of the attorney's office. The agreement and proposed exchange was prepared under the direction of City Council on <br /> September 28, 2005 when Council passed a motion "to direct the City Manager to execute a property exchange <br /> agreement with Bob and Leslie Quinney based on the amended points of agreement." A map is attached to illustrate the <br /> subject areas and the resulting property configurations. Upon execution and return of the deed to me, we will deliver the <br /> deed to escrow for Quinney's signatures and closing of escrow subject to fulfilling the remaining conditions as set out in <br /> the exchange agreement.
