From looking at this one, it is <br /> another of those that we need to watch carefully to insure we don't end up looking like we say one thing to private <br /> developers but operate differently internally. Especially since we had a similar type of issue go sideways <br /> between our departments regarding vegetation abatement on this site a number of months ago. <br /> The other thing I want to avoid is any aspect of one division of the city pointing to another and saying its their <br /> problem. As I'm understanding the situation, the office of the Urban Forester doesn't have any jurisdiction here. <br /> We commented upon and made recommendations regarding the development plans regarding which trees were <br /> good enough to be saved but not anything more. <br /> Unfortunately, the media (and often the Council) doesn't seem to accept that the Urban Forester's office doesn't <br /> have jurisdiction on anything within the city that has dealings with trees. As I think I understand it, enforcement <br /> of tree protection in developments are typically under jurisdiction of the LUMS or in a majority of building permit <br /> cases exempt from the tree preservation code. <br /> In this case where the County is also involved and I'm told their contract provisions with Wildish didn't cover tree <br /> protection, I'm not sure how we answer the question of who is in control regarding the impact to the trees. My <br /> instructions to Jan have been that this is a project where Development Division has had a strong on-going <br /> interest and that questions should be forwarded to Development Division (Sunna Murray as I under stand it) with <br /> as little comment as possible from him. I think the best tact possible is for Jan to stay out of it.
