I sent this to Cathy at prime her that their may be some fallout from this in the future.
to
Thanks Johnny
From: MEDLIN Johnny R
To: Briner, Cathy (RIS1)
Subject: FW: Walnut Grove Construction Project
Date: Wednesday, September 28, 1994 3:41 PM
Hi Cathy, If your wondering why you got cc'd on this from Jan, it's because I'm getting paranoid on tree issues
and I asked him to cc it to you because of the potential for media controversy. From looking at this one, it is
another of those that we need to watch carefully to insure we don't end up looking like we say one thing to private
developers but operate differently internally. Especially since we had a similar type of issue go sideways
between our departments regarding vegetation abatement on this site a number of months ago.
The other thing I want to avoid is any aspect of one division of the city pointing to another and saying its their
problem. As I'm understanding the situation, the office of the Urban Forester doesn't have any jurisdiction here.
We commented upon and made recommendations regarding the development plans regarding which trees were
good enough to be saved but not anything more.
Unfortunately, the media (and often the Council) doesn't seem to accept that the Urban Forester's office doesn't
have jurisdiction on anything within the city that has dealings with trees. As I think I understand it, enforcement
of tree protection in developments are typically under jurisdiction of the LUMS or in a majority of building permit
cases exempt from the tree preservation code.
In this case where the County is also involved and I'm told their contract provisions with Wildish didn't cover tree
protection, I'm not sure how we answer the question of who is in control regarding the impact to the trees. My
instructions to Jan have been that this is a project where Development Division has had a strong on-going
interest and that questions should be forwarded to Development Division (Sunna Murray as I under stand it) with
as little comment as possible from him. I think the best tact possible is for Jan to stay out of it. Unfortunately,
he's not very good an answering pressuring questions from the media or council.
I really hope my paranoia regarding trees anymore doesn't come to anything and the rest of the project sails
smoothly.
Thanks
Johnny
From: STASZEWSKI Jan
To: Murray, Sunna (RIS1); McKerrow, Mike (RIS1)
Cc: WEBER John J; MEDLIN Johnny R; Briner, Cathy (RIS1); Weinman, Richie (RIS1)
Subject: Walnut Grove Construction Project
Date: Wednesday, September 28, 1994 1:44PM
I continue to receive calls from citizen regarding the trees within the Walnut Grove
Page 1
