Garden Way
Eugene, OR 97401
Subject: VEGETATION REMOVAL FORM CENTENNIAL RIGHT -OF -WAY
TAXLOT NO: 17- 03 -28 -40 -01400
Dear Bruce,
This letter is to confirm the several items discussed at the meeting conducted
in your office on April 27, 1988. Present at that meeting was yourself, Jim
Stuart of my office and myself. The topic of discussion was the City's desire
to have the brush and black berry vines removed from the public right -of -way of
Centennial in those areas abutting your property.
Concerns you expressed:
1. The vegetation removal should not occur prior to May 8th to allow
young birds still nesting time to leave the nest.
2. The old right -of -way fence, which is overgrown with brush and in many
cases down on the ground, needed to be removed before machine mowing
of the vegetation was practical.
3. A visual vegetation screen between your property and the road was
desireable.
To accommodate the concerns of both parties the following agreement was made.
1. The City of Eugene would remove the old fence and all black berry
vines from Centennial right -of -way between the roadway and a point not
more than five feet onto your property.
2. The City would leave all areas worked upon in a machine mowable
condition.
3. The City would perform no work prior to May 15, 1988.
4. You would assume the responsibility for the future mowing of the
right -of -way as needed to maintain compliance with the Municipal Code.
