The code does require property owners to maintain the <br /> vegetation in the right -of -way abutting their property, even on undeveloped <br /> rights -of -way. Our policy is to require abutting property owners to <br /> maintain the vegetation in an undeveloped right -of -way to the centerline of <br /> the r /w. In that sense the owner who sprayed everstepped his bounds in <br /> spraying beyond the centerline of the alley, and we informed him and his <br /> lanscaping contractor of that. I do feel we tried very hard to mediate the <br /> situation, getting each side to see the others concerns and developing a <br /> common understanding of the rules, but we can never seem to make everyone <br /> happy. I think we probably are all concerned that this is not' necessarily <br /> the best way to deal with the situation but we don't have any other recourse <br /> to require a different approach. I think part of it is that Judy and the <br /> other neighbors are upset that this one neighbor is doing something they <br /> don't agree with and they'd like the City to mediate. Doesn't look like we <br /> can. The only question remaining in my mind is since this is an alley can't <br /> be restrict what happens in our right of way. I know that we have the <br /> abutting owners be responsible for the areas outside the curbs for improved <br /> street areas but where its not improved do we expect the abutting owner to <br /> take care of it in total? Also, seems like the other half of the alley <br /> should have some rights if they also bear part of the responsibility? <br /> Sounds like the issue is complete for the moment in that the plants have <br /> been removed but this won't be the end since they likely will reappear. <br /> Hopefully at that time we will have a better solution.
