On 5- 30 -95, I received a call from Judy Geirs. She was upset because the neighbor had just cut out all of <br /> the berries which had been sprayed last month. She also said that the neighbor was planning to apply <br /> Casaron to the dirt alley to kill the berry roots. She wants the City to prevent this application. I don't <br /> perceive that this application will result in a direct or apparent discharge of a pollutant into the channel, <br /> which would have to happen to result in a violation of the stormwater pollution ordinance. I shared this <br /> opinion with Ms Geirs and told her that I did not believe that the City would have any authority to prevent <br /> this application. (the alley is relatively level with no obvious vector to carry the chemical directly into the <br /> channel. Ms. Geirs objected to my interpretation of'the situation and stated that in a conversation with Les <br /> Lyle on 4 -28 -95 that Les felt that there was a problem with a pesticide application at this site, as the <br /> chemical would leach into the channel. She asked why I hadn't spoken with Les so that we would be in <br /> agreement on this issue. I was not aware that Les had made an assessment of this situation. <br /> What position is the City taking regarding the potential for leaching to the stormwater system of a <br /> pesticide chemical applied to an adjacent area with no obvious or apparent flow (discharge) of the chemical <br /> to the stormwater system? Are we taking the position of stopping a pesticide application if it is felt that <br /> some of the chemical may leach into the stormwater system.
