s A June 18, 2009
E COP 7 Mr. John Davis
2285 Snelling Drive
E U G E N E Eugene, OR 97405
P arks and Subject: Blackberry v'
Open Space j ines growing within the Beltline Floodway easement
Dear Mr. Davis:
Keeping Eugene Green
I was forwarded your request asking if the City would remove the Armenian blackberry vines
encroaching on your adjacent property from the Beltline Floodway. Prior to writing this
A DIVISION OF PUBLIC WORKS response, I visited the site, searched for documents specific to the Beltline Floodway in this
1820 ROOSEVELT BLVD area, and reviewed our stormwater maintenance policies for applicability.
EUGENE, OREGON 97402 1
(541) 682-4800 I did find this section of the Beltline Floodway is located on Eugene School District 4J land at
FAX (541) 682 -4882 Cal Young Middle School. I also found the 4J property is encumbered by a stormwater
easement for the Beltline Floodway.
WWW.EUG EN E- OR.GOV /PARKS
Our maintenance policies were developed to assure the conveyance of stormwater thus
minimizing the potential for flooding. While the City is responsible for all maintenance
activities on City -owned lands, on drainage easements on private land we typically only
PARKS AND OPEN SPACE PLANNING maintain the vegetation within the channel when we feel it may impede the conveyance of
stormwater and lead to flooding.
PARK OPERATIONS As our policies relate to this request, we don't usually maintain vegetation outside the channel
in easements unless required for equipment access to maintain flows or in a few rare cases
URBAN FORESTRY where a written maintenance agreement with the property owner has designated that
responsibility to the City. I was unable to find any maintenance agreements with School
NATURAL RESOURCES District 4J which place vegetation maintenance responsibilities with the City. Due to this I
would believe that vegetation maintenance outside the channel is not something the City would
do and such would remain the responsibility of the property owner.
I will copy this response to 4J in case they might be aware of any maintenance agreements
which I did not locate.
I appreciate your patience, . cerel (CCO Sin
Johnn ' .
