The plantings are <br /> questionable, but most would be very easy to drive over or around. <br /> Does this situation pose a serious risk to life or safety? <br /> I didn't see any condition that posed a serious risk to life or safety. <br /> Conclusion: <br /> Although the travel path within this unimproved alley is not completely free of plant materials, it is <br /> passable and does not constitute a serious enough public nuisance or hazard to warrant our enforcement <br /> action. <br /> I would make a couple observations: <br /> No permits were obtained for plantings or signage within the alley. Due to this neither the plantings nor <br /> the ad -hoc signage have any protected status. Therefore anyone wanting to pass through the alley would <br /> be within their rights to drive over the plantings and /or signage or to cut any limbs that they believed <br /> impeded their way. <br /> I understand an arborist has been engaged to prune the large walnut tree from 2760 University by June <br /> 17 I also understand that Whitey has pledged to prune the limbs of the Ponderosa Pine trees and other <br /> trees planted along the alley in the fall, in order to reduce obstructions. I would suggest to Whitey that he <br /> consider doing this much sooner because I suspect he would prune these with much more care than may <br /> be the case if someone else decides they need removed in order to use the alley this summer. <br /> From the letters I have viewed, there seem to be neighbors on each side of this issue and this already is <br /> the subject of a growing neighborhood discord. I have found that Community Mediation Services @ 344- <br /> 5366 or communitymediationservices.com can be very helpful in determining a mutually acceptable <br /> solution.
