Tim received a telephone complaint about this
spraying. Person refused to identify themselves. We believe
this to have been a honest mistake and they have been very
cooperative.Tim has informed them verbally not to spray on our
property in the future. We do not think it will happen again
any do not think anything is to be gained by filing a
complaint with the state. Would probably just get the Boulders
folks more upset with the City. Thus we are not planning any
additional action. Part of the property to which the
chemical was applied apparently does belong to the Boulders,
but a portion of it is clearly City property. The Manager
informed me that this has been done regularly for the last
several years.
I'm awaiting a call from the owner of Elms Landscaping
to provide the details (materials, rate of applicaiton and
application technique). So far everyone is being cooperative.
We do have the option of complaining to the ODA since we are
the property owner and have suffered "chemical trespass" .
Apparently the goal of this spray program has been to
keep the view open to the river. The bank in question is
steep and rocky and can not be mowed easily or neatly. My
concern re: application technique is whether or not the
operator dismounted and sprayed away from the river ou aimed
the spray applicator downhill toward the river. (The river
was running very full this AM.) My site survey revealed some
residue near the water line, but it did appear that an effort
Page 1
