It states “Plant replacement <br />due to vehicle damage, vandalism or theft will be the responsibility of the Agency according to <br />00170.80”. I know it was not what either you or Mike Bellmore wanted to hear but the contract does <br />not support us directing Wildish to remove and replace the damaged tree as part of contract work. At <br />the establishment inspection meeting Mike said he wanted the tree pulled out if ODOT was not going to <br />have Wildish replace it as part of the contract and the COE did not have the funds to pay for a new one <br />to be planted.
