Section VI (actions), under what the City shall do it makes mention under point 4 and 7 of dollar <br /> amounts not to be exceeded per survey year. Is a survey year considered every calendar year in which the <br /> City is party to this agreement or is a survey year only those years in which a population survey is <br /> completed (i.e. 1997 and every 10 years thereafter)? Kinda makes a difference in the cost. <br /> 2. Same section, point 8, it says the City will notice all cooperators for comment if any planning, <br /> maintenance or construction will affect known populations. My question is what constitutes planning? If, <br /> for example, we are thinking about and evaluating alternatives for relocating a trail or whether it will be <br /> beneficial or cost effective to build a fence along the community garden, does this constitute planning and <br /> do we need to notify cooperators? Or, in this context, does planning mean that when we have identified a <br /> preferred alternative or have made a decision on what we want to do that we notify them and solicit <br /> comment? I know this is kind of a picky differentiation, but it seems to me that simply saying that we will <br /> notify cooperators when planning will affect populations is fairly vague and open to a wide range of <br /> interpretation. You will note on that at the beginning of <br /> the agreements sections a disclaimer sentence exists which <br /> basically states each of the parties will do these things if <br /> funds are available. <br /> I would request each person who receives this document to look <br /> it over and E -MAIL their comments back to me prior to January <br /> 1, 1997.
