Box 11364 <br /> Eugene, OR 97440 <br /> Dear Larry: <br /> This is to confirm the conversation we had today, and follows a <br /> directive I verbally gave to Tony Koth yesterday. Because of <br /> damage to the endangered specie plant habitat that is <br /> unacceptable at both the citizen and agency level, and because <br /> the amount of fill and excavation in a wetland area has likely <br /> exceeded the threshold for which a permit is required, I am <br /> requesting that work on the adidas Trail Lighting Project cease <br /> until further notice. <br /> I understand the circumstances behind the work that has been <br /> done. The regulatory agencies do not waive regulations just <br /> because unforeseen conditions develop. With have dbthe <br /> work been done in the drier time of year, <br /> smaller excavation amounts, and one could determine for sure <br /> where the endangered plants are, and consequently avoided damage. <br /> At this point in time, the City of Eugene is in the public eye <br /> and under scrutiny as to the corrective action we take. Site <br /> activity of any kind would not be in the best interest of the <br /> City until we can get feedback from the regulatory agencies.
