While <br /> you would need to review the specific code requirements with the Planning <br /> Department, in general some of the requirements would be: <br /> a. 100% agreement of all abutting property owners; <br /> b. 2/3 agreement of all neighbors within a rectangular zone that would be <br /> defined as centered on the alley, extend 200 feet both to the east and <br /> west, and would extend 400 feet from both the north and south end of <br /> the alley; <br /> c. The immediately abutting property owners would be required to <br /> purchase, at fair market price as determined by an appraisal, all the <br /> area between their existing property line and what would become their <br /> new property line at the east side of the relocated alley; <br /> d. A survey would be required and subsequent legal description <br /> prepared, <br /> Not including item c and d above, my understanding is that alley vacation fees <br /> would be in the range of $1,600.00. <br /> 3. Purchase a permanent non - exclusive access easement from the <br /> City of Eugene on the park property to serve as legal access to <br /> your parcel. <br /> It is estimated that such an easement beginning at the end of 16 Avenue and <br /> extending to the north across the frontage of your property would cost <br /> approximately $7,500. <br /> 4. Develop the existing alley. <br /> While this seems to be the least preferred option by all parties concerned, it still <br /> is a legal option that you can pursue. While I have not researched this matter in <br /> depth, I would anticipate the total costs for this option to be greater than the total <br /> costs of option three but less than option two. <br /> It is my understanding that options two through four would gain you the needed <br /> access to the property.
