Reimburse CITY for reasonable road related preliminary <br /> engineering costs incurred prior to COUNTY becoming the lead <br /> organization for PROJECT in amount not -to- exceed $9,302.93. <br /> 13. At the successful conclusion of the process specified in <br /> ORS 373.270 and 271.330, relinquish to CITY the COUNTY -owned real <br /> property needed or acquired for PROJECT right -of -way (if any). <br /> CITY SHALL: <br /> 14. Submit to COUNTY an accounting of all actual road related <br /> engineering costs incurred prior to COUNTY becoming lead organization <br /> for PROJECT. <br /> 15. In consideration of the undertakings of the COUNTY outlined <br /> herein, convey to COUNTY the CITY owned real property needed for PRO- <br /> JECT right -of -way. To facilitate the construction schedule, posses- <br /> sion of the real property to be conveyed to COUNTY is hereby relin- <br /> quished to COUNTY. A separate agreement between CITY and COUNTY will <br /> occur regarding actual conveyance. <br /> 16. Authorize COUNTY, its contractor or agents to enter CITY - <br /> owned real property for the purpose of planting and maintaining land- <br /> scaping required by the Willamette Greenway permit issued by CITY. <br /> 17. Accept ownership and maintenance of landscaping, and re- <br /> sponsibility for any other conditions stipulated by the Willamette <br /> Greenway Conditional Use Agreement signed by CITY and COUNTY, follow -_ <br /> ing surrender of jurisdiction of project to CITY. <br /> 18. Accept maintenance responsibility for PROJECT immediately <br /> upon final acceptance of the PROJECT by COUNTY. <br /> 19. Request COUNTY surrender of jurisdiction of COUNTY owned <br /> real property needed for PROJECT pursuant to ORS 373.270 or 271.330 <br /> by passage of appropriate CITY legislation within 60 days after final <br /> acceptance of PROJECT by COUNTY. <br /> 20. Own and maintain the finished improvements as a city <br /> street. <br /> 21. Provide in any agreement with any organized user group or <br /> legal entity that uses portions of Alton Baker Park, including, but <br /> not limited to, the BMX track and the golf course (if built), a re- <br /> quirement that before the user group schedules an event requiring <br /> parking spaces beyond the capacity of public parking in the area, <br /> they shall provide the University of Oregon Athletic Department 14 <br /> days advance written notice.
