92 -288 <br /> INTERGOVERNMENTAL AGREEMENT <br /> THIS AGREEMENT is entered into by and between LANE COUNTY, a <br /> political subdivision of the State of Oregon, hereinafter referred to <br /> as COUNTY, and the CITY OF EUGENE, a municipal corporation existing <br /> under the laws of the State of Oregon, hereinafter referred to as <br /> CITY. <br /> RECITALS <br /> 1. ORS 190.010 and the Lane County Home Rule Charter provide <br /> that units of local government may enter into agreements for the per- <br /> formance of any and all functions and activities that a party to the <br /> agreement, its officers or agents, have authority to perform; and <br /> 2. COUNTY and CITY desire to cooperate to improve traffic flow <br /> on Centennial Boulevard and enhance public access to Alton Baker Park <br /> in the Autzen Stadium area. <br /> 3. Through adoption of the FY 90 -91 to FY 94 -95 Capital Im- <br /> provement Program, the Board of County Commissioners indicated its <br /> desire to contribute up to $500,000 for road - related expenses <br /> associated with extending the LEO HARRIS PARKWAY from the Willamette <br /> Science and Technology Center entrance to the existing gate four of <br /> Autzen Stadium at Centennial Boulevard, hereinafter termed PROJECT. <br /> The estimate in the Capital Improvement Program has proven to be too <br /> low. The Board has approved the PROJECT with the costs now estimated <br /> to total $575,000. <br /> 4. CITY and COUNTY desire to execute an agreement that author- <br /> izes COUNTY to acquire right -of -way, construct and make improvements <br /> to LEO HARRIS PARKWAY, including authorization to enter on CITY owned <br /> property prior to acquisition in order to perform road - related work <br /> on the PROJECT, pursuant to ORS 373.260. <br /> AGREEMENTS <br /> CITY AND COUNTY AGREE THAT: <br /> 5. The recitals are incorporated herein as if fully set forth. <br /> As used in this agreement the following words shall have the meaning <br /> indicated: <br /> 5.1 Activities include: surveying, designing, preparing <br /> plans and specifications, acquiring necessary right- - <br /> of-way, acquiring necessary permits, calling for bids, <br /> awarding and administering the construction contract, <br /> field engineering and inspecting. <br /> 5.2 Improvements include: street improvements having the <br /> traffic carrying capacity and characteristics as gen- <br /> 1 - INTERGOVERNMENTAL AGREEMENT <br /> (County /City - Leo Harris Parkway) bcj /5817 <br />
