<br /> PERMIT
<br /> THIS AGREEMENT made and entered into this 17th day of November, 1986, by and
<br /> between the State of Oregon, acting by and through the State Board of Higher Education,
<br /> for and on behalf of the University of Oregon Athletic Department, hereinafter referred
<br /> to as the UNIVERSITY, and Lane County Public Works, Parks Division, 3040 North Delt.
<br /> Highway, Eugene, OR 97401, hereinafter referred to as the LESSOR.
<br /> WITNESSETH:
<br /> 1. That under the terms and conditions set forth hereinafter, the said
<br /> LESSOR grants to UNIVERSITY a non - assignable right for such UNIVERSITY to use anc'
<br /> occupy that portion of Alton Baker Park as detailed on attached map, Exhibit A,
<br /> at Eugene, Oregon, hereinafter referred to as the FACILITY, for a continuous per:.od
<br /> beginning on execution on the 17th day of November, 1986, daylight hours only, for
<br /> the sole purpose, and no other, of: conducting hammer, discus, and shot put practice.
<br /> 2. The UNIVERSITY agrees that the FACILITY shall be located a certain
<br /> distance from the bike /foot path in order to avoid any risk of conflict and to reduce
<br /> the likelihood of accidents.
<br /> 3. The UNIVERSITY agrees to pay to the LESSOR as rent for the use of the
<br /> FACILITY listed in Paragraph 1, a sum equal to $0. UNIVERSITY shall pay upon the execu-
<br /> tion of this agreement a deposit of $0 to apply to said rent. The UNIVERSITY agrees to
<br /> construct and maintain, at its own expense, two concrete slabbed safety throwing rings;
<br /> to supply, to place and to maintain perimeter warning signs to the public, and to
<br /> maintain liability insurance, through the State of Oregon's self - insurance program.
<br /> To the extent permitted by the Oregon Constitution, Article XI, Section 7, and the pro-
<br /> visions of ORS 30.260 through 30.300, LESSOR agrees to indemnify and save harmless the
<br /> UNIVERSITY from and against all claims, demands, liabilities, and judgments arising out
<br /> of, related to, or in connection with, any negligent act or omission of LESSOR and its
<br /> employees, and UNIVERSITY agrees to indemnify, and hold harmless LESSOR from and against
<br /> all claims, demands, liabilities, and judgments arising out of, related to, or in connec
<br /> •
