INTERGOVERNMENTAL AGREEMENT <br /> BETWEEN: The City of Eugene, an Oregon Municipal Corporation, <br /> by and through its Public Works Department (City) <br /> AND The State of Oregon, acting by and through the <br /> State Board of Education, for and on behalf of <br /> The University of Oregon Athletic Department (University) <br /> RECITALS <br /> A. University has developed and used land at Alton Baker Park for a hammer <br /> throw practice field under an agreement with Lane County signed November 17, 1986, which <br /> was the owner of that portion of Alton Baker Park. <br /> B. In March of 1993, Lane County transferred to City title to the area of Alton <br /> Baker Park which contained the hammer throw practice field. <br /> C. Prior to transfer of title, Lane County initiated termination of the agreement <br /> with University to allow City, as the new owner of the property, to enter into a similar use <br /> agreement with University. <br /> D. University acknowledges that City and the Willamalane Park and Recreation <br /> District have formed a Citizen Planning Committee (CPC) to develop a plan for recreational <br /> uses of the eastern portion of Alton Baker Park. The CPC will recommend a plan to City. <br /> If the plan ultimately adopted by City is in conflict with University's use of the area, the <br /> agreement may be terminated as set forth in 3. below. <br /> AGREEMENT <br /> City agrees to grant a non- assignable right to University to continue University's use <br /> of a portion of Alton Baker Park for a hammer throw practice field, subject to the following <br /> understandings and conditions: <br /> 1. Sits. Approximately 100,000 square feet south of Day Island Road and east <br /> of the Community Gardens in the configuration as shown in Exhibit "A" and located as <br /> shown in Exhibit "B." <br /> 2. Duration. To run for three years, beginning July 1, 1993 and running through <br /> June 30, 1996. <br /> Agreement - 1 %Me <br />
