Upon notification by Agency, State will coordinate with local law enforcement for <br /> the removal of transient camp occupants within State right of way. <br /> State will be responsible for cleaned up of transient camp waste within State's <br /> area of responsibility as outlined in this Agreement. <br /> 6. Access to State Plans and Reports. State acknowledges and agrees that <br /> Agency and their duly authorized representatives shall have access to such <br /> plans and reports of State concerning construction of the multi use paths that are <br /> pertinent to this agreement for maintenance and repair planning purposes and to <br /> make excerpts and transcripts. State shall retain and keep all files and records <br /> for a minimum of six (6) years following termination of the agreement. <br /> 7. State Authorized Representative. <br /> a. Agency's Project Manager shall be notified in writing of any contact <br /> information changes during the term of this Agreement. <br /> D. Memorandum of Understanding (MOU) Concerning Design Enhancements <br /> At a point in the future, the local Eugene - Springfield community may recommend <br /> specific WRB Project design enhancements. Some of these recommendations may <br /> be included into the area for which Agency shall be responsible to maintain. <br /> Specific details on final design and acceptance of the design enhancements are not <br /> known at this time, it is therefore difficult to define the actual design and construction <br /> material and how they might be cared for. This MOU provision addresses the <br /> general approach that will be used to define each Party's responsibilities, and is <br /> enumerated below. <br /> 1. Once design enhancement designs are completed and are accepted by both <br /> Parties the following will be negotiated by the Parties and added to this Agreement <br /> by amendment: <br /> a. Policy outlining expectations on expected life span, maintenance and repair <br /> effort, and removal and /or disposal of design enhancements once they are <br /> deemed physically or organically deteriorated or damaged beyond repair and <br /> Key 14259 Page 9 of 17 <br />
