7.7 All costs (excluding City staff time) related to future revisions or amendments of the TDM <br />Plan approved by the City Manager. <br />7.8 All costs to the placement and dismantling of temporary barricades or other facilities in <br />Alton Baker Park (including along Leo Harris Parkway, as defined in the TDM Plan) to <br />keep pedestrians off Alton Baker Park turf. <br />8. Effect and Duration of TDM Plan Approval <br />8.1 Other preexisting IGAs will remain in force and will control in the event of a conflict with <br />the TDM Plan, except to the extent that they are expressly addressed in the TDM Plan. <br />Without limiting the generality of the foregoing provision, University and City <br />acknowledge that the future use, through 2007, of parking lots 8 and 9 near Autzen <br />Stadium is controlled by the East Alton Baker Master Plan and the IGA between the two <br />parties signed in 1997. Parking spaces in parking lots 8 and 9 will not be counted toward <br />the number of spaces required under Section 2.1 of this IGA. Consistent with the East <br />Alton Baker Park Master Plan and the 1997 IGA between the parties, University may lose <br />control of parking lots 8 and 9 in 2007, and may lose control of the hammer throw area in <br />2005. <br />8.2 If University fails to comply with the conditions or fulfill its other obligations in the TDM <br />Plan or this IGA, City may give University notice of the failure and a reasonable <br />opportunity to cure the failure of compliance or fulfillment. If University does not comply <br />with or fulfill the conditions or obligations within a reasonable period as specified in <br />City's notice, then City may revoke its approval of the TDM Plan and this IGA. Upon such <br />revocation by City, there shall no longer be a City - approved transportation demand <br />management plan (or City - approved intergovernmental agreement incorporating same) in <br />effect for the Autzen stadium complex. The effect of the revocation is that University will <br />have to provide a sufficient number of parking spaces to meet the requirements of the <br />Eugene Code in existence at the time in the absence of a City - approved intergovernmental <br />agreement incorporating a transportation demand management plan for the Autzen stadium <br />complex. If University fails to meet those requirements, it shall be fined by City, and <br />University agrees to pay, a stipulated penalty with respect to each major stadium event in <br />an amount equal to the general admission ticket price for the major stadium event times the <br />"excess attendance." The "excess attendance" is the number of people attending the major <br />stadium event in excess of 41,788. The stipulated penalty is in addition to any other <br />enforcement rights or remedies available to City with respect to the failure to comply with <br />the parking requirements of the Eugene Code, which rights and remedies are cumulative <br />and may be exercised singularly, concurrently, simultaneously or successively. <br />9. Effective Date. This Agreement shall become effective on the date of the last signature below. <br />INTERGOVERNMENTAL AGREEMENT - 8 <br />
