Key points to be included in an Operating Agreement between the Eugene Family <br /> YMCA and the City of Eugene for the development of a recreational facility in <br /> Bethel. <br /> Land: <br /> The City and the YMCA will enter into a 25 -year renewable lease (occupancy permit or use <br /> permit ?) , in which the YMCA will pay the City $1.00 /year for the land agreed upon by both <br /> parties. OK <br /> The City will ensure that the land and infrastructure is adequate for the development of this <br /> facility in regards to sewage lines, water, electricity, street access, adequate parking, permits,( ? ?) <br /> zoning ( ? ?), and related traffic control costs ( ? ?). (utilities need researched, ) <br /> The land agreement will provide the YMCA with a minimum of 4 acres (should be site specific), <br /> inclusive of Phase I development, to ensure that future expansion is possible. <br /> Facility Design and Construction: <br /> The YMCA will be responsible for the capital funding of Phase I and all subsequent phases, <br /> exclusive of an aquatics center which may be built by the City in the future. <br /> An aquatics center will not be built in Phase I, or during any subsequent phase without City <br /> approval and funding. Negotiations for the development, design, ownership, maintenance and <br /> operations of the Aquatic Center will be entered into and determined at the future time when <br /> both parties agree that such a facility is deemed a necessary development. <br /> The YMCA will determine facility components and design of all phases in compliance with <br /> land -use regulations. (These should be some city involvement or oversight ?) <br /> The YMCA will consider and/or support additional improvements to the proposed facility should <br /> the City desire and fund such improvements. <br /> The YMCA will retain the title to all facilities built by the YMCA. (Reversion to City if not <br /> operated by YMCA for expressed purpose.) <br /> The YMCA is responsible for the upkeep and maintenance of all facilities owned by the YMCA. <br /> Upon the development of an aquatics center, the City and the YMCA will negotiate its upkeep <br /> and maintenance agreement at that time. <br /> Operations <br /> The YMCA will maintain exclusive operating rights of and financial responsibility for all <br /> programs and services housed in the facility, exceptional to specific agreements made with the <br /> City, school district or other partners. <br />
