charge within thirty (30) days of notice of the charges, Owner may terminate the lease without <br /> further notice. In addition, notwithstanding the foregoing, if Lessee's default creates a risk of <br /> injury to the public or to users of the facility, Owner may close the premises immediately and may <br /> exercise its option to cure the default or to terminate the lease on such abbreviated notice, of not <br /> less than seven (7) days, as it deems appropriate to the circumstances in light of the nature of the <br /> risk posed by the act of default. <br /> 18. Notice. All notices under this lease shall be deemed to be properly served if forwarded <br /> by registered or certified mail to the last address previously furnished by the parties hereto. Until <br /> hereafter changed by a party by notice in writing, notices shall be sent to Owner at 22 West 7th <br /> Avenue, Eugene, Oregon 97401, and to Lessee at P.O. Box 7491, Eugene, OR 97401. <br /> 19. Assignment. Except as provided in this lease, no part of the premises may be assigned, <br /> mortgaged or subleased by Lessee, nor may a right of use of any portion of the premises be <br /> conferred on any person voluntarily or involuntarily by other means, without prior written consent <br /> of Owner. However, nothing contained herein shall bar the assignment of this lease by the Lessee <br /> to a successor nonprofit corporation formed by Lessee, and Owner expressly consents to said <br /> assignment. <br /> 20. Attorney Fees. If suit or action is instituted by either party to establish or enforce any <br /> right under this lease, to recover any amounts due hereunder; to correct any default of any <br /> covenant, term or condition; or to litigate any other matter arising from the execution of this <br /> lease. The prevailing party in the trial court and the prevailing party on any appeal shall recover <br /> reasonable attorney fees awarded by the trial and appellate courts in addition to costs and <br /> disbursements.
