C. Alternatives /Options <br />1. The Board can proceed as mentioned above under which case staff <br />will be directed to proceed with: a) The transfer of the 4 acre tax <br />foreclosed parcel; b) Analyze the County's road fund properties <br />adjacent to Delta Highway and determine if any of the property can be <br />classified as surplus and eligible for transfer to the City; and c) <br />Survey and complete legal descriptions of the retained and surplus <br />road properties. Additionally, it will be necessary for County Legal <br />Counsel to provide the Department with an opinion if the road fund <br />parcels can be used for park purposes without compensation since their <br />purchase was prior to the 1980 Constitutional Amendment which <br />prohibits the use of road fund assets for non -road purposes. <br />2. The Board can direct staff to forego any transfer until the road <br />issues are completely cleared up. Under this alternative, all <br />transfers to the City would be delayed for up to one year and <br />possibly indefinitely. <br />3. The Board can direct staff to inform the City and the Friends of <br />Delta Ponds that we wish to retain ownership of the County owned <br />property in the Delta Ponds area. Under this alternative, staff will <br />assume that our involvement with the creation of the Delta Ponds <br />Nature Park will be limited to a cursory review of any plans made by <br />the City for the park to insure that County properties are managed and <br />maintained in their present form. <br />D. Recommendation <br />I recommend alternative one. <br />E. Timing <br />Upon direction by the Board, staff will inform the City and the <br />Friends of Delta Ponds of the Board's decision and staff will proceed <br />as directed. <br />IV.
