DRAFT <br /> LEASE OF SURPLUS PROPERTY <br /> BOND LAND PARK <br /> The City of Eugene Parks Planning Office will accept offers to <br /> lease approximately 33,000 square feet of Bond Lane Park. <br /> Subject property lies south of the swale on the western half of <br /> the park at a point 300 - 450 feet north of Bond Lane. Because <br /> the area is judged surplus, but not saleable due to restrictions <br /> currently in effect, the City will accept offers to lease that <br /> area from one or more parties that includes an option to purchase <br /> at a future time. <br /> The area does not abut public right of way; therefore, the <br /> property must be leased by an owner of property that does. The <br /> following tax lots are adjacent to the proposed parcel for lease: <br /> 17- 03- 19 -1 -2 -505, -518, -521, -807 and -808. In the event more <br /> than one party is interested, a meeting will be held to consider <br /> a logical division for lease purposes. <br /> The provisions for leasing any portion of this park land include: <br /> 1. An annual lease rate of $.015 per square foot (minimum), <br /> or $495 per year for the full area. <br /> 2. No structures other than fences can be erected; no <br /> permanent paving may be installed; landscape or garden <br /> plantings are permitted. <br /> 3. The entire area needs to be leased by one or more <br /> parties. The City will not lease fractions of the target <br /> area. <br /> 4 . Lesse 1 be liability for any property tax burden. <br /> 5. ine�lea`se rate will remain constant; any change in the <br /> valuation (currently $.50 per sq. ft. for oversized lots in <br /> that area) placed on the leased parcel by the Department of <br /> Assessment and Taxation would cause corresponding change in <br /> the lease amount. <br /> 6. The lessee will agree to a lease agreement that contains <br /> a Hold Harmless Statement, wherein the lessee agrees to <br /> protect the City from any claims directed to the City for <br /> losses by any party arising out of damages incurred on the <br /> subject property. <br /> 7. At such time as the Willakenzie Plan is revised to allow <br /> the sale of any leased parcels, any lessee shall have the <br /> first right of refusal to purchase the land under <br /> their lease for the assessor's valuation at the time of <br /> sale. The City, at its option and cost, may obtain an <br /> appraisal to determine land value and use that as the <br />
