day as long as the use does not disrupt the operation of school or the instructional <br /> program. City and District agree to the following: <br /> (1) The joint facilities on District property will be used in a fashion that <br /> maximizes community use. However, such use must be compatible with protecting the <br /> safety and security of students, staff, and visitors. District reserves the right to control <br /> use and access to the facilities during the instructional day from 7 a.m. to 4 p.m. <br /> Instructional days are those days scheduled by the school board for instruction. <br /> (2) District reserves the right to restrict partial or all use for up to 48 hours to <br /> respond to a safety or welfare emergency. The superintendent or designee will inform <br /> the city manager or designee of such a decision. Any restriction that extends beyond 48 <br /> hours requires the concurrence of the city manager or designee. <br /> (3) School grounds, including the Youth Sports Parks, will be posted with <br /> signs informing the public that the areas are school grounds and that public access is <br /> welcome, but may be restricted without prior notice for security or, while school is in <br /> session, for instructional reasons. <br /> 11.2 Dogs. Dogs will not be permitted on the multi -use artificial athletic <br /> fields. Dogs on leashes may be brought into the Youth Sports Parks provided that they <br /> do not disrupt the educational program, are not a physical or sound nuisance or danger, <br /> and provided that the owners' clean-up dog litter. <br /> 11.3 Parking During the Instructional Day. Members of the community <br /> arriving by car to use the facilities during the instructional day may not park in the <br /> school lots without prior approval of the school administrator. <br /> Section 12 Cancellation <br /> Notwithstanding any other provision herein, each party reserves the right to <br /> cancel this Agreement by written notice. Such cancellation shall be effective one year <br /> after notice is given. Should District cancel or fail to perform under this agreement, <br /> without cause, District shall reimburse or in some appropriate manner make City whole <br /> for the depreciated value of City's investment that is withdrawn due to the cancellation <br /> or for the value due to City for District non - performance.
