4 <br /> Youth Sports Parks <br /> Response to 43 proposal <br /> January 5, 2001 <br /> Page 2 <br /> Concerns about the 43 Proposal <br /> 1. The proposal is predicated on the idea that there are boundary lines delineating the <br /> Youth Sports Parks from the Athletic Fields and that the risks and liabilities can <br /> therefore be easily separated, but this isn't the case. <br /> 2. The proposal would require that maintenance responsibilities be segregated, with 4J <br /> responsible for maintenance of the athletic fields and the City responsible for <br /> maintenance of the Youth Sports Parks. <br /> ► The current maintenance agreement between the entities is based on <br /> functionality, staff expertise and practicality and was developed <br /> specifically to promote inter - agency cooperation, efficiency and wise use <br /> of public funds. Examples are the coordinated mowing program and <br /> irrigation maintenance, which is area where the City has specific expertise. <br /> ► Undoing the cooperative maintenance agreement and going back to <br /> segregated maintenance responsibilities would be inefficient and costly. It <br /> would shift workloads to areas where there is inadequate capacity (for <br /> ti example, 43 doesn't have as large an irrigation maintenance capacity as <br /> the City) and would result in an inefficient use of resources. <br /> ► PWM staff feels that the current maintenance agreement is working well <br /> for both entities. <br /> 3. The 43 proposal would make the City responsible for all claims arising from the <br /> skate parks, including claims alleging design defects. <br /> ► The City and 4J jointly participated in the design development and 43 <br /> administered the design contract. <br /> ► 43 is currently scheduling the Cal Young Skate Park. <br /> 4. The IGA was written by 43 staff Bill Hirsch and David Piercy. The current 43 <br /> proposal would totally change the previous agreement regarding liability issues <br /> and require that the IGA be re- written. <br /> ► The current 43 proposal is not consistent with previous discussions, <br /> fi <br />
