L i J <br /> V a <br /> JANUARY 5, 2001 MEETING SUMMARY <br /> City of Eugene and School District 4.3 <br /> Response to 4J Proposal on Youth Sports Parks Risk Management Issues <br /> In Attendance: Jeff Lankston, Tim Rhay, Andrea Riner, Renee Grube, Myrnie Daut, <br /> Cathy Joseph <br /> In November 2000, the 43 Risk Manager and his risk management consultants, who <br /> also represent the City of Eugene, proposed amending the existing IGA in order to, in <br /> their opinion, more equitably address the liability and risk management issues arising <br /> from the Youth Sports Parks. 4J feels that, under the terms of the existing IGA, they <br /> are assuming the majority of the risk arising from a joint endeavor, since they own all <br /> of the property. The 4J Risk Manager seemed especially concerned about being <br /> responsible for all claims arising from the condition of the premises. <br /> The 43 proposal would make the City of Eugene responsible for all liability arising from <br /> the "Youth Sports Parks "; 4J would be responsible for all liability arising out of the <br /> Athletic Fields, as described below. City staff met to review and consider the 4J proposal <br /> on January 5, 2001. Below is a summary of issues, concerns and comments on the <br /> proposal. <br /> The IGA defines Youth Sports Parks as those parks "constructed at Cal Young Middle <br /> School, Churchill High School, and Sheldon High School. Youth Sports Parks may <br /> include such features as upgraded natural surface fields, accessible basketball courts, <br /> skateboard facilities, improved tennis courts, picnic tables, accessible outdoor <br /> bathrooms, walks, plantings, fences, and night- use -low -glare lighting." <br /> The IGA defines Athletic Fields as "Artificial surface multi -use athletic fields ('artificial <br /> surface fields') suitable for high school football and soccer...constructed at Churchill <br /> High School, North Eugene High School, Sheldon High School and South Eugene High <br /> School." <br /> General Comments <br /> While the consultants who represent both the City of Eugene and 43 have identified <br /> benefits to both entities from 43's proposal, the City staff reviewing the proposal does <br /> not believe that the 43 proposal is workable from an operational perspective. Although <br /> 43 and the consultants warn that any claims that do arise under the existing IGA will be <br /> difficult to manage due to the entities' different insurance programs and claims <br /> philosophy, the City has experience handling claims involving other entities, for <br /> example, EWEB, Lane County and private contractors, and have been able to resolve <br /> the claims without undue difficulty. <br />
