Memo on Ridgline Park and Land Use Compliance <br /> July 10, 2001 <br /> Page 4 of 7 <br /> lands; <br /> (b) The proposed use will not significantly increase fire hazard or <br /> significantly increase fire suppression costs or significantly increase risks to fire <br /> suppression personnel; and <br /> (c) A written statement recorded with the deed or written contract with the <br /> county or its equivalent is obtained from the land owner which recognizes the <br /> rights of adjacent and nearby land owners to conduct forest operations consistent <br /> with the Forest Practices Act and Rules for uses authorized in subsections (4)(e), <br /> (m), (s), (t), and (w) of this rule." <br /> (2) Lane Code Chapter 16: <br /> LC 16.211 sets the standards for uses on F -2 Forest land. Under LC 16.211(3)(c) 2(4)(c) parks <br /> are allowed as uses subject to Director approval and are subject to LC 16.211(5) which states, <br /> "Uses authorized by LC 16.211(3)(a) -(s) * ** may be allowed provided <br /> the following requirements are met: <br /> (a) The proposed use will not force a significant change in or significantly <br /> increase the cost of, accepted farming or forest practices on agriculture or forest <br /> lands. <br /> (b) The proposed use will not significantly increase fire hazard or <br /> significantly increase the fire suppression costs or significantly increase risks to <br /> fire suppression personnel. <br /> (c) * * * a written statement recorded with the deed or written contract with <br /> the County or its equivalent is obtained from the landowner which recognizes the <br /> rights of adjacent and nearby landowners to conduct forest operations consistent <br /> with the Forest Practices Act and Rules. <br /> (d) * * *„ <br /> Parks Planning Statute and Rule: <br /> Oregon Laws 1997, Chapter 604 set standards and authorized LCDC rulemaking for parks <br /> planning. The legislation appears at ORS 195.120 - 197.125. The statute addresses both state <br /> and local parks. For local parks the statute did three things: <br /> • Directed the LCDC to adopt rules for allowable uses in local parks that have adopted <br /> master plans. See ORS 195.120(2)(a). <br />
