This statute and its rule are discussed below. <br /> (3) Lane Code Chapter 16: <br /> LC 16.212 sets the standards for uses on EFU land. Under LC 16.212(4)(c) parks are allowed as <br /> a special use subject to Hearings Officer approval and are subject to compliance with LC <br /> 16.212(5) criteria which require: <br /> "(a) Compatibility of the use or activities associated with the use with the <br /> Agricultural Lands Policies of the Rural Comprehensive Plan Policies, ORS <br /> 215.243 and the purpose of this zone. <br /> (b) The use, or activities associated with the use, will not force a <br /> significant change in or significantly increase the cost of accepted farming or <br /> forestry practices on nearby lands devoted to farm or forest use. <br /> (c) The use, or activities associated with the use, complies with other <br /> conditions considered necessary be the Approval Authority in order to meet the <br /> applicable approval criteria. <br /> (d) * * *" <br /> Standards for parks that apply on Forest land: <br /> (1) LCDC Rules: <br /> OAR Chapter 660, Division 6 implements Goal 4, Forest Lands. OAR 660 - 006 - 0025(4) lists <br /> certain uses that allowed on Forest land subject to the review standards of OAR 660 -006- <br /> 0025(5). The use listed in OAR 660 - 006- 025(4)(f) is: "Public parks including only those uses <br /> specified under OAR 660 - 034 - 0035." The reference to Division 34 is the 1998 Parks Planning <br /> Rule which implements the 1997 Parks Planning Statute. <br /> Thus, there are two key sets of standards for park siting on Forest land. There is the Parks <br /> Planning Rule and Statute, which is the same as for EFU land, and is discussed below. In <br /> addition, there are the standards in OAR 660 - 006 - 0025(5), which are: <br /> "(5) A use authorized by section (4) of this rule may be allowed provided <br /> the following requirements or their equivalent are met. These requirements are <br /> designed to make the use compatible with forest operations and agriculture and to <br /> conserve values found on forest lands: <br /> (a) The proposed use will not force a significant change in, or significantly <br /> increase the cost of, accepted farming or forest practices on agriculture or forest <br />
