CORRECTIVE ACTION You are required to notify the 'ali¢rb matt R -OSHA field office of corrective action taken for violations not corrected at the time of inspection. The attpched "Letter of Corrective Action" must be completed and mailed to the field office listed on this letter. The "Letter of Corrective Action" must be received by the field office on or before the latest correction date on the citation. Failure to return this letter by that time may result in another inspection to verify compliance. Violations corrected at the time of inspection and witnessed by OR- OSHA's compliance officer do not require a response. Posting - The law requires that a copy of this Citation and Notification of Penalty be posted immediately in a prominent place at or near the location of the violation(s) cited herein, or, if it is not practicable because of the nature of the employer's operations, where it will be readily observable by all affected employees. This Citation must remain posted until the violation(s) cited herein has (have) been abated, or for 3 working days (excluding weekends and holidays), whichever is longer. Employer Appeal Rights - You must abate the violations referred to in this Citation by the dates listed and pay the penalties proposed, unless you appeal this citation. The appeal must be received by the Department within 20 days of your receipt of the citation. You may appeal any violation, penalty, or correction date on this citation. Your appeal must be in writing; be signed; and include your name, address, telephone number, optional report number, date received, each item appealed, and the reason for the appeal. The appeal should also state whether you want an informal conference to discuss and possibly resolve the appealed items. If you do not appeal, this citation becomes a final order of the Department of Consumer and Business Services. IMPORTANT NOTE: APPEALING A SERIOUS VIOLATION OR THE REASONABLENESS OF THE CORRECTION DATE DOES NOT AUTOMATICALLY EXTEND OR STAY THE CORRECTION DATE. YOU MAY REQUEST AN EXTENSION OF THE CORRECTION DATE THROUGH OR -OSHA OR REQUEST THAT THE WORKERS' COMPENSATION BOARD HEARINGS DIVISION, FOR GOOD CAUSE, ISSUE A STAY OF THE CORRECTION ORDER, PENDING DISPOSITION OF THE CASE (OREGON ADMINISTRATIVE RULE 438 -85- 326(2)). Penalty Payment - Penalties are due within 10 working days of receipt of this notification unless contested. Make your check or money order payable to "DEPARTMENT OF CONSUMER AND BUSINESS SERVICES," and mail to Department of Consumer and Business Services, Fiscal Services Section, Labor & Industries Bldg, 350 Winter St NE, Salem OR 97310. Please indicate the Inspection Number on the remittance and return a copy of the invoice with payment. OR -OSHA does not agree to any restrictions or conditions or endorsements put on any check or money order for less than the full amount due, and will cash the check or money order as if these restrictions, conditions, or endorsements do not exist. Notification of Corrective Action - For violations which you do not appeal, you should notify OR -OSHA promptly by letter that you have taken appropriate corrective action within the time frame set forth on this Citation.
