08/30/96 14:32 $`541 683 6826 EUG PUBLIC WORKS -'--' MAINTENANCE [1002 /002 <br /> ADMINISTRATIVE ORDER NO. 58 -96 -18 <br /> of the <br /> Executive Director of the Public Works Department <br /> ORDERING TIIE TEMPORARY CLOSURE OF SCOBERT PARK <br /> The Executive Director of the Public works Department of the City of Eugene finds <br /> that: <br /> A. Section 1.003 of the Park Rules, as amended by Administrative Order No. 58 -96-16 <br /> on August 16, 1996, authorizes the temporary closure of parks and/or facilities when the public <br /> need to preserve the welfare and safety of residents in the vicinity of the park(s) outweighs the <br /> public's need for access to parks and/or facilities. <br /> B. Scobert Park, located at 1180 West 4th Avenue, has become a haven for illegal <br /> activities creating an atmosphere that is unfit and unsafe for use by residents of the area. In <br /> addition, the existing park vegetation has been heavily abused and a temporary closure of the park <br /> would allow the vegetation time to recover and regenerate. <br /> C. The neighborhood, by way of a neighborhood petition s u supported by while � r <br /> Community Council's executive board, has requested that the park <br /> residents of the area explore options for the future use of the park to serve the residents and <br /> employees of the area. <br /> Now, therefore, based on the above findings, which are hereby adopted, <br /> IT IS HEREBY ORDERED THAT: <br /> 1. Scobert Park, located at 1180 West 4th Avenue, is hereby closed to entry by all <br /> persons other than police officers, authorized City employees, or persons with written <br /> authorization, from the Public Works Director or the Parks Maintenance Manager, effective 12:01 <br /> a.m., September 9, 1996. Written authorization may be granted to: 1) those persons maintaining <br /> an already-established garden within the boundaries of Scobert Park, such access solely for the <br /> purpose of maintaining the garden; and 2) members of the Whiteaker Community Council Task <br /> Team for Scobert Park Improvement, such access solely for the purpose of executing planned <br /> improvement projects to the park. The closure shall remain in effect until December 1, 1996. <br /> 2. Clearly visible signs shall be posted at park entry points, and such other locations <br /> deemed appropriate advising the public that pursuant to this Administrative Order No. 58- 96 -18, <br /> entry is prohibited, and that any unauthorized person entering or remaining within the park after <br /> the date of closure will be subject to the imposition of a fine not to exceed $500 or confinement <br /> in jail not to exceed 30 days or both such fine and imprisonment. <br /> Dated this 3! f day of August, 1996. <br /> / <br /> nom <br /> Executive Director, Eugene Public Works Department <br />
