. 4Z r-, Ytt,t k 4
ADMINISTRATIVE ORDER NO. 58-12-05
of the
Executive Director of the Public Works Department
EXTENDING THE TEMPORARY CLOSURE OF A PORTION OF
SCOBERT PARK ESTABLISHED BY ADMINISTRATIVE ORDER NO.
58- 10 -04.
The Executive Director of the Public Works Department finds that:
A. Pursuant to the authority of Administrative Order No. 21 -03 -12 issued by the City
Manager, the Executive Director of the Public Works Department is authorized to regulate City
parks, protect park visitors and the park environment, and adopt rules regarding the use of parks.
B. Section 1.003 of the Parks and Open Space Rules, adopted by Administrative
Order No. 58- 09 -11 -F, authorizes the temporary closure of all or any portion of a park, open
space, or facility upon finding that conditions that threaten the welfare or safety of nearby
residents exist and the need to preserve their welfare and safety outweighs the public's right of
access to the park, open space and/or facility.
C. On April 16, 2012, I issued Administrative Order No. 58 -10 -04 closing a portion
of Scobert Park, located at 1180 West 4 Avenue, effective 12:01 a.m. on April 23, 2010 until
April 22, 2012.
D. It is necessary to extend the closure because the above - mentioned portion of
Scobert Park continues to be a haven for illegal activities creating an atmosphere that threatens
the welfare and safety of the residents in the area. Efforts to curtail the illegal activities,
including the fencing of the area, have been unsuccessful.
E. The need to protect and preserve the welfare and safety of residents living nearby
Scobert Park outweigh the public's right of access to the fenced portion of Scobert Park.
Now, therefore, based on the above findings, which are hereby adopted:
IT IS HEREBY ORDERED THAT:
1. The closure of the portion of Scobert Park, located at 1180 West 4 Avenue,
delineated by a black wrought iron fence erected by the City, is extended and shall be closed to
entry by all persons other than police officers, authorized City employees and persons with
written authorization from the Public Works Director or the Parks Maintenance Manager until
April 22, 2014.
Administrative Order - Page 1 of 2
