Within the channel banks, and within a conservation area that <br /> extends 40 feet from the top of the bank on each side, the /WR provisions restrict uses that <br /> can occur there. We have reviewed the channel and bank repair work proposed to address <br /> channel and bank instability in Braeburn Creek, as outlined in materials you have provided to <br /> Jack Long. Our review indicates that some of the activities outlined constitute an emergency <br /> repair of a failing slope or eroding channel bank as defined in Eugene Code Section <br /> 9.4930(2)(o). • <br /> Project numbers 10, 11, 12, 13, and 14 within the Club House reach, appear to address a <br /> bank failure that threatens the structural integrity of the ETA Club House, a legally <br /> constructed structure. In addition, due to state and federal permit requirements for in- channel <br /> work that limit the portion of the year in which this work can take place, our understanding is <br /> that Projects 10 -14 could not be completed during this year's in- channel work period if <br /> Standards Review Approval was required prior to commencing work. It is our further <br /> understanding that it is of the utmost importance that these projects are completed before the <br /> next rainy season starts in the fall of 2006. Therefore, these projects can be carried out as <br /> emergency repairs with no Standards Review approval required provided that ETA complies <br /> with provisions of ED 9.4930(2)(o), as discussed below. <br /> EC 9.4930(2)(o) requires, within seven days of commencing the work, submittal to the <br /> Eugene Planning Director of a written evaluation prepared by a certified engineer that <br /> includes: <br /> 1.
