There is the temptation to strain the meaning of the variance <br /> criteria but is impossible to ignore how they have been <br /> interpreted. To ignore the requirements of the criteria in <br /> situations where the issue may not be contested and enforce the <br /> criteria where an issue will be appealed is not desirable. The <br /> result is uneven treatment of applicants and perhaps the delay of <br /> the appropriate remedy, council action to revise the criteria. <br /> Unfortunately, needed legislation often only finally is brought <br /> forth when a deserving application has to be denied. <br /> C. Conclusion <br /> As stated above, the location of parking off -site is an integral <br /> and important part of this conditional use permit proposal. If <br /> parking is to be located on -site, a vastly different application <br /> would be required.
