RESOLUTION NO. 4683 <br /> A RESOLUTION EXTENDING THE COMPLETION DATE FOR <br /> CHILD CARE INCORPORATED TO SATISFY CONDITIONS <br /> UNDER RESOLUTION 4442. <br /> The City Council of the City of Eugene finds that: <br /> A. On January 23, 1995, Resolution 4442 was adopted authorizing the transfer of two <br /> undeveloped parcels of real property, Tax Lots 700 and 800, Assessor's Map 17- 04 -25 -13 on <br /> Thomason Lane abutting Maurie Jacobs Park, to Child Care Incorporated ( "CCI "), subject to the <br /> following conditions: <br /> (a) That CCI apply for and obtain a Conditional Use Permit for its <br /> intended use of the property within four years from the adoption of Resolution 4442; <br /> and <br /> (b) That CCI provide confirmation to the City that at least 80% of the <br /> funding for the relocation project had been secured prior to commencement of <br /> construction of the project and that the funding be confirmed, construction <br /> commenced, and the relocation occur within five years from the adoption of <br /> Resolution 4442. <br /> B. CCI has obtained a Conditional Use Permit and has provided confirmation to the City <br /> that at least 80% of the funding for the relocation project has been secured. <br /> C. A building permit was issued in October, 2000, and it is in the public interest that <br /> the expiration date for commencement of construction, and the relocation, as set forth in Resolution <br /> 4442, should be extended to December 31, 2003. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br /> Municipal Corporation of the State of Oregon, as follows: <br /> Section 1. Based on the above findings, which are hereby adopted, the City Manager is <br /> authorized to execute such documents necessary to transfer, for no monetary consideration, Tax Lots <br /> 700 and 800, Assessor's Map 17- 04 -25 -13 on Thomason Lane, Eugene, Oregon, to CCI to be used <br /> to provide child care for families, including low income families. <br /> Section 2. If CCI fails to commence construction and relocate to the Thomason Lane site <br /> by December 31, 2003, title to the two parcels shall revert to the City. <br /> Resolution -1 <br />
