INTERGOVERNMENTAL AGREEMENT <br /> for the <br /> JOINT USE AND DEVELOPMENT OF <br /> Q . t ARTIFICIAL TURF ATHLETIC FIELDS <br /> BETWEEN: Bethel School District 52, a unit of local ( "District ") <br /> government of the State of Oregon <br /> AND: The City of Eugene, a unit of local ( "City ") <br /> government of the State of Oregon <br /> RECITALS <br /> A. ORS 190.010 provides that units of local government may enter into agreements for the <br /> performance of any and all functions and activities that any party to the agreement, its assigned <br /> personnel or agents, have authority to perform. <br /> B. City and District have successfully shared the use, operation and maintenance of facilities for <br /> many years and desire to share resources and work collaboratively to jointly develop and manage the <br /> artificial turf athletic fields described in this Agreement. <br /> C. City and District enter into this Agreement in the spirit of cooperation and with the <br /> commitment that the shared facilities will be used extensively by the community, especially by its <br /> children and youth, and that they will be maintained in good repair for many decades to come. <br /> AGREEMENT <br /> Section 1: Development <br /> 1.1 Artificial Turf Athletic Fields. Multi -use, artificial turf athletic fields (the "Fields "), <br /> suitable for football, soccer, lacrosse and other field sports will be constructed at Willamette High <br /> School and Meadow View School. <br /> 1.2 Project Management. District shall manage the development and construction of the <br /> Fields (the "Project ") in consultation with City. The design and selection of artificial turf product <br /> and the Project budget and schedule shall be subject to City's prior approval, which shall not be <br /> unreasonably withheld. <br /> 1.2.1 For purposes of seeking City's prior approval, District shall submit to City <br /> design plans that show, at a minimum, all proposed structures (including restrooms, <br /> concession buildings, storage buildings and grandstands), parking areas, access, field layout <br /> Intergovernmental Agreement 2008 - 01034: Joint Use And Development of Artificial Turf Athletic Fields <br /> Page 1 of 10 May 9, 2008 <br />
