a nationwide permit (NW 3 (Maintenance) or 5 (Scientific Measurement Devices)). In reviewing the <br /> application, the Corps will apply the designation criteria stated in Appendix B of the Plan to determine <br /> the intensity of the alternatives analysis. Those wetlands which meet the criteria for protection would <br /> receive the most stringent application of the altematives analysis. In nearly all cases, wetlands <br /> designated in the Plan for development would be considered preferable alternatives. The Plan criteria <br /> for identifying sites suitable for protection are: <br /> - presence of rare plants; <br /> - site has Metropolitan Plan designation of Natural Resources; <br /> - site is within the 100 -year floodplain; <br /> - site is near a perennial waterway; • <br /> - site is connected geographically or hydrologically to other wetlands or waterways; <br /> - site contains a high diversity of wildlife habitat or contributes to the diversity of wildlife <br /> habitat within the region; <br /> - protection of site would further the goals and objectives of this plan; <br /> - presence of unique Willamette Prairie Grassland plant community. <br /> Applications for proposed fills greater than one acre but less than ten acres in wetlands which do not <br /> meet the protection criteria would receive a lesser level of evaluation. This flexibility in evaluating <br /> compliance with the Section 404(b)(1) Guidelines is supported by Regulatory Guidance Letter 93 -2, <br /> dated 23 August 1993. <br /> Applications for fills affecting less than one acre of wetland would be processed as Letters of <br /> Permission with a 15-day notice, through the process described in Part C., above. If the wetland of <br /> less than one acre meets certain criteria in the Plan for designation as development, it will be <br /> considered to be so designated. Those criteria are: that the site is relatively isolated or disconnected <br /> from the larger system of wetlands and waterways and that the site is adjacent to or surrounded by <br /> • <br /> existing development. <br /> These procedures for evaluating applications to fill wetlands not designated in the Plan will be in <br /> effect until the Plan is amended by the City of Eugene to include all wetlands identified in the <br /> inventory, and the amended plan is approved by DSL, the Corps and EPA. The draft DSL Approval <br /> Order (Appendix B of this notice) requires the City to amend the Plan to include these wetlands by <br /> July 31, 1997. <br /> 5 <br />
