2. the accuracy of the field survey of wetland boundaries (except for those wetlands with <br /> jurisdictional delineations previously reviewed and accepted by the Corps and DSL); <br /> 3. whether project impacts are minimized; <br /> 4. whether the project - specific mitigation plan is consistent with the Plan, and is provided in <br /> sufficient detail; <br /> 5. whether endangered species and cultural resources issues have been resolved. <br /> In partial reliance on the City of Eugene's findings, the Corps will perform and document a final <br /> evaluation of the proposed activity to determine compliance with these six elements. If the Plan is <br /> approved and these requirements are met for individual projects within the Plan area, the analysis <br /> required under section 404(b)(1) of the Clean Water Act and other environmental requirements will be <br /> satisfied and a Letter of Permission will be issued. <br /> D. Conditions Which Would Apply to the Alternative Procedure: <br /> The alternative procedure would be in place for five years from the time of approval, so long as the <br /> following conditions are met: <br /> 1. The City of Eugene complies with all the conditions of the Order from the Oregon Division <br /> of State Lands approving the Plan. <br /> 2. The overall goals of the Plan are met when taking into account the reasonable time required <br /> for mitigation to have met its objectives. <br /> 3. The City of Eugene, within its level of authority, maintains a leadership role in resolving <br /> conflicts and enforcement actions, and in correcting compensatory mitigation that fails to meet its <br /> objectives for sites identified in the Plan, notwithstanding the fact that the Corps and EPA retain their <br /> full enforcement powers. <br /> 4. The City of Eugene adopts and complies with wetland management parameters and <br /> ordinances, including buffering and wetland protection. <br /> 5. The City of Eugene prepares and submits to the Corps by December 31 of each year an <br /> annual report on the status of all authorized fill activities, mitigation actions required and completed, <br /> mitigation monitoring required and copies of monitoring reports. The annual report shall include an <br /> analysis of wetland alterations by type and area, including wetland restoration and enhancement <br /> completed by type and area, and land acquired by location. <br /> E. Standard Individual Permits <br /> Appendix A of this notice describes the inventory of wetlands located within the study area. As noted <br /> in that appendix, the Plan was adopted by the City of Eugene and Lane County in August 1992, based <br /> on a wetland inventory completed in 1989. Subsequent inventories were completed in 1993 and 1994, <br /> in response rules adopted by DSL for Wetland Conservation Plans. The Plan will be amended to <br /> include the additional wetland sites; the amendment process is expected to require 12 to 18 months to <br /> complete. In the interim, any applications for fill of these additional wetlands will be processed as <br /> follows. <br /> Applications for development of wetlands located within the Plan area, but which are not yet included <br /> in the Plan, will be processed as individual permits with public notice, unless the activity is eligible for <br /> 4 <br />
