BEFORE THE DIVISION OF STATE LANDS <br /> OF THE STATE OF OREGON <br /> In the Matter of a Request by the ) <br /> City of Eugene for Approval of the ) PROPOSED ORDER <br /> West Eugene Wetlands Plan as a ) <br /> Wetland Conservation Plan ) <br /> THE DIVISION OF STATE LANDS APPROVES THE CITY OF EUGENE WEST <br /> EUGENE WETLANDS PLAN AS A WETLAND CONSERVATION PLAN UNDER <br /> ORS 196.678 TO 196.682. <br /> BACKGROUND <br /> The state's wetland resources policy is stated at ORS 196.672(1) -(10) and <br /> 196.805(1) -(3). In part it is the state's policy to: <br /> 1. Promote the protection, conservation, and best use of wetland resources, their <br /> functions and values through the integration and close coordination of statewide planning <br /> goals, local comprehensive plans, and state and federal regulatory programs. <br /> 2. Maintain a stable resource base of wetlands through the mitigation of losses of <br /> wetland resources and the adoption of the procedural mitigation standard currently used <br /> by federal agencies. <br /> 3. Reduce the delays and uncertainty which can occur in the current wetland <br /> planning and regulatory framework through improved coordination of the provision in <br /> ORS 196.800 to 196.905 with local land use planning and regulation and by providing <br /> mechanisms for expedited permit review consistent with the protection and conservation <br /> of wetland resources. <br /> 4. Continue to meet the requirements of federal law in the protection and <br /> management of wetland resources, while asserting the interests of this state, in concert <br /> with those of local governments in urging the federal resource and regulatory agencies to <br /> develop a uniform wetland policy and more consistent, cohesive standards to implement <br /> the Federal Water Pollution Control Act (33 U.S.C. 1344). (ORS 196.868). The 1989 <br /> Oregon Legislative Assembly established a planning process designed to integrate <br /> planning for wetland resources with the state wetland permitting program. The <br /> legislation established criteria and standards for developing and reviewing locally <br /> adopted Wetland Conservation Plans (ORS 196.678 to 196.684). <br /> WEST EUGENE WETLANDS PLAN BACKGROUND <br /> The City of Eugene in its metropolitan plan identified the west Eugene area as <br /> industrial and commercial area for the City for more than 20 years. The <br /> Eugene - Springfield Metropolitan Area General Plan (Metropolitan Plan) has guided <br /> public decisions since 1982. The City of Eugene has adopted and the state has <br /> approved _refinement plans to the Metropolitan Plan that include the Willow Creek Special <br /> Area Stud Trt982) and the Bethel - Danebo Refinement Plan (1982).
