Commission, hereinafter called "State "; LANE COUNTY, a political subdivision of the State of Oregon, by and through its Board of County Commissioners, hereinafter called "County";" and the McKENZIE WATE CONTROL DISTRICT, a political subdivision of the. State of Oregon, by and through its Board of Directors, hereinafter called "District "; . • W I T N E S S E T H s RECITALS: , .1. For the purpose of furthering the development of a highway _ system adapted to the needs of the people of the State of Oregon and for the safe and expeditious flow of traffic, State has relocated and shall place under contract for construction, as a throughway, as defined in ORS 3 74.010 a section of the Pacific Highway, State Primary Highway No. 1 hno.m as the McKenzie River - Judkins Point Section in Lane County, and in connec- tion therewith, the relocation and construction of the Eugene - Springfield • Secondary Highway No..227 shown as "Q" Street on Drawing Exhibit "A" as is attached hereto and by this reference made a part hereof. • 2. Pursuant to ORS 366 770, State may enter into cooperative agreements with any one or more counties or other municipalities of the State for the construction, reconstruction repair or maintenance of any state highway and provide for an allocation of the cost of the project to the contracting parties. • 3. Pursuant to ORS 553.090 and ORS 553.710., District may contract with county and state or any of their departments or agencies for the con- struction, preservation, improvement, operation or maintenance of any works necessary or convenient for draining land and controlling flood or sur- face water. The said relocated section of the Pacific Highway will be routed across the McKenzie River flood plain in Lane County and during flood stages of the McKenzie River each year, it is anticipated that flood- water may cross said highway and result in property damage and inconven- ience to the traveling public. 5. State, County and District propose to enter into this- agree-ment for the purpose of controlling the flood conditions existing_ in the area through which the said section of the relocated Pacific Highway and said "Q" Street are to be constructed and to provide for necessary and ade- quate flood control for said highway and street, The work to be accomplished under this agreement is hereafter referred to as "project ". n Af EUGENE
