Commission, hereinafter called "State "; LANE COUNTY, a <br /> political subdivision of the State of Oregon, by and through its Board of <br /> County Commissioners, hereinafter called "County";" and the McKENZIE WATE <br /> CONTROL DISTRICT, a political subdivision of the. State of Oregon, by and <br /> through its Board of Directors, hereinafter called "District "; . <br /> • W I T N E S S E T H s <br /> RECITALS: , <br /> .1. For the purpose of furthering the development of a highway _ <br /> system adapted to the needs of the people of the State of Oregon and for <br /> the safe and expeditious flow of traffic, State has relocated and shall <br /> place under contract for construction, as a throughway, as defined in ORS <br /> 3 74.010 a section of the Pacific Highway, State Primary Highway No. 1 hno.m <br /> as the McKenzie River - Judkins Point Section in Lane County, and in connec- <br /> tion therewith, the relocation and construction of the Eugene - Springfield <br /> • Secondary Highway No..227 shown as "Q" Street on Drawing Exhibit "A" as <br /> is attached hereto and by this reference made a part hereof. • <br /> 2. Pursuant to ORS 366 770, State may enter into cooperative <br /> agreements with any one or more counties or other municipalities of the <br /> State for the construction, reconstruction repair or maintenance of any <br /> state highway and provide for an allocation of the cost of the project to <br /> the contracting parties. <br /> • <br /> 3. Pursuant to ORS 553.090 and ORS 553.710., District may contract <br /> with county and state or any of their departments or agencies for the con- <br /> struction, preservation, improvement, operation or maintenance of any works <br /> necessary or convenient for draining land and controlling flood or sur- <br /> face water. <br /> The said relocated section of the Pacific Highway will be <br /> routed across the McKenzie River flood plain in Lane County and during <br /> flood stages of the McKenzie River each year, it is anticipated that flood- <br /> water may cross said highway and result in property damage and inconven- <br /> ience to the traveling public. <br /> 5. State, County and District propose to enter into this- <br /> agree-ment for the purpose of controlling the flood conditions existing_ in the <br /> area through which the said section of the relocated Pacific Highway and <br /> said "Q" Street are to be constructed and to provide for necessary and ade- <br /> quate flood control for said highway and street, The work to be accomplished <br /> under this agreement is hereafter referred to as "project ". <br /> n <br /> Af EUGENE <br />
