inventories of `jurisdictional wetlands." Federal and state regulators (and as a <br /> consequence local agencies) rely on certain indicators as to the possibility that a site <br /> may contain a jurisdictional wetland. Examples of these indicators include: the <br /> National Wetlands Inventory prepared by the U.S. Fish and Wildlife Service and the <br /> hydric soil classifications contained in the soil surveys prepared by the Natural <br /> Resources Conservation Service. If any of these indicators are positive, state and <br /> federal agencies will assume the wetland is jurisdictional unless more site specific <br /> I information is provided that indicates otherwise. A property owner can hire a <br /> wetlands scientist to survey a site for wetlands and to make a "determination" <br /> whether a jurisdictional wetland exists or not. Once the determination is made and <br /> the property owner desires to fill the wetland, a wetland "delineation" is needed to <br /> determine the boundaries of the jurisdictional wetland. <br /> I 4. Appeal of designation. An applicant who disagrees with the Director's final <br /> -1 PP l: PP <br /> determination may appeal that decision within the time and manner prescribed in section R- 6.645- <br /> F.11 of these Rules. <br /> I <br /> R- 6.645 -F Erosion Prevention Permits. <br /> I <br /> 1. Permit Required. Except as otherwise provided in these rules or provisions of the <br /> Eugene Code, 1971, no person or governmental agency shall commence any construction related <br /> activity without first obtaining from the City an erosion prevention permit if the construction related <br /> activity will: <br /> 1.1 Disturb more than five acres of land; <br /> 1.2 Incrementally disturb more than five acres of land, s uch as a phased <br /> commercial, industrial, or residential development; or <br /> 1.3 Is located in a sensitive area as designated pursuant to R- 6.645 -E of these <br /> rules. <br /> 2. Waiver of Erosion Prevention Permit. Notwithstanding any other provisions of <br /> this section, the following activities shall not require an erosion prevention permit.
