and will consider public comments before forwarding a recommended ordinance to the
Council. Time will be provided for visitor comments. To confirm the meeting date please
contact staff listed below in late August.
Adoption Procedures. The ordinance establishes the legal framework for the erosion program,
such as what is regulated, who is affected, and penalties for violations. The ordinance also
provides authority to the City Manager for adopting the companion administrative rules. The
administrative rules provide implementation details of the program such as permitting
requirements, standards of compliance, and definitions. While the ordinance and rules are
companion documents, each has a separate adoption process. Public notice and opportunities for
public comment will be provided. The processes are as follows:
• Ordinance. City Council is the decision maker for the ordinance. A public hearing is
tentatively scheduled for October 7, 1996. Public notice will be provided to the interested
parties mailing list and in the newspaper.
• Administrative Rules. The City Manager is the decision maker for the rules. Assuming the
ordinance is adopted, a minimum 15 -day public notice period rules will be provided to the
mailing list and in the newspaper asking for public comments. The Manager will consider
the comments and make a final action.
If the ordinance and rules are adopted according to the above time frame, the program will
become effective in early 1997.
We are very interested in receiving feedback from the community during this stage so we can
move forward with a program which is effective and practical. The public comments received in
February on the initial drafts were legitimate and important issues. Those comments and the
work of the DAC have resulted in a better end - product. Thank you for your past input and for
taking time to review and comment on the current proposal.
For any additional information or scheduling of outreach presentations, please either contact me
at 683 -6855 or Tim Bingham at 687 -4410.
Sincerely,
c- 1 ti
Caa
Michelle Cahill, Manager
Water Resources Team
2
