BARBARA KELLER {'w m <br /> EUGENE CITY COUNCIL <br /> EUGENE CITY HALL <br /> EUGENE, OREGON 97401 <br /> DEAR MS_ KELLER_ <br /> I am writing to you as my City Council representative to express serious <br /> concerns regarding the sale and potential "clear cutting" of a 46 acre tract of land <br /> adjacent to my property. This parcel is jointly owned by Frank Anderson and <br /> Closen Christian of Leaburg, Oregon and is currently being offered for sale by <br /> Coldwell Banker Realtors at a price of $590,000 (refer to enclosed flyer). Lane <br /> County assessors property description is 180320 -400 and 180320 -500, Account #'s <br /> 687291 & 687309. It is presently zoned R1/PD. <br /> The property encompasses a major portion of the headwaters of Amazon <br /> Creek and is characterized by steep forested slopes, and extensive riparian areas. <br /> The predominate forest type is second growth Douglas fir varying from pole size to <br /> mature trees with scattered old growth fir and ponderosa pine. Also present are <br /> areas of oak woodland. This forest supports a diverse flora including the Calypso <br /> • Orchid and the Wayside Aster (Aster vialis), a Federal C -2 candidate proposed for <br /> listing as endangered. <br /> This land also forms a connector between the Ridge Line traiUSpencer's <br /> Butte Park to the south and the Amazon Creek (Rexius) jogging trail /Frank <br /> Kinney Park to the north. It is frequently visited by hikers, jogger's, trail bike <br /> enthusiasts bird watchers and others. The City of Eugene South Hills Study <br /> recommended that this property be acquired as an active -use park "based upon <br /> existing and anticipated population growth in the area" (Joint Parks Committee <br /> Report, South Hills Study, pgs. 6 & 14). <br /> Clearcutting would have a serious negative environmental impact on the <br /> existing surrounding neighborhoods in terms of soil erosion/slope instability, <br /> windthrow of border trees, Amazon Creek siltation, increased fire danger from <br /> logging slash and destruction of viewshed. Additionally, the portion of my <br /> property bordering this PUD has a number of large fir trees which would be <br /> extremely vulnerable to windthrow onto my home if the whole area above were <br /> clear cut. My opposition is not to planned development of the area but to attempts <br /> to bypass the entire PUD process (with its provisions for local neighborhood input) _ <br /> resulting in wholesale destruction of the forest. <br /> My understanding is that there is a "loophole" in the Eugene City Code <br /> which allows a landowner to circumvent the PUD process by stating their only <br /> interest is in harvesting timber and not land development, thereby allowing them <br /> to "clear cut" their property. This is wrong. I ask you to initiate City Council <br /> action to plug this "loophole ". Land owners and developers should not be able to <br /> short- circuit the PUD process in this fashion.
