That risk will remain <br /> as long as the code is on the books in its current form. The <br /> other alternative would be to continue doing the permitting <br /> (not any investigations or enforcement) until we can get the <br /> code changed. I guess this would be a policy decision based <br /> on the "risk" assessment of how likely it would be that our <br /> refusing to issue a permit would cause a blow -up ending in a <br /> court situation. <br /> In the code rewrite, I personally feel it is a very good idea <br /> to leave some level of the existing tree protection on private <br /> lands in place in the code as long as we are also clear that <br /> enforcement is to be a civil matter between offended parties. <br /> There needs at least to be a mechanism left that will <br /> prohibit clear cutting large parcels immediately before they <br /> go in for development. The community would get upset if we <br /> had another south hills clear cutting incident like the one we <br /> had with Polanski /Clifton on Spring a couple of years ago. I <br /> will proceed on that basis unless instructed otherwise. <br /> I will get a meeting set up with Jerry Lidz and Scott <br /> Plamondon.
