, TRFES Page 1 <br /> UFMP Policies Related to Street Trees <br /> #4. The City will establish or enhance the character of its streets through the use of trees in rights -of -way. <br /> #10. Amend the Eugene Code to provide suitable space for trees to grow in new or reconstructed street <br /> rights -of -way to maximum extent practical. <br /> #13. The City will require an approved street -tree plan in developments involving the creation of streets. Assure <br /> that the party obtaining approval provides for planting the street trees, according to the approved plan, as each <br /> lot or area is developed. <br /> Tree Policy - Assumptions <br /> 1. Code amendments will be limited to Ch 7 if possible; amendments to Ch 9 will be avoided. <br /> — City Engineer has current authority to adopt standard specfications for work done in public r/w. <br /> - Amendments to Ch 9 require a larger public process, approval of the Planning Commission, and could <br /> conflict with other amendment processes currently underway. <br /> — UFMP policies 10 & 13 will require amendments to Ch 9. <br /> — Street tree specs would not apply to private streets. <br /> 2. Specifications adopted by City Engineer will include details such as spacing, sight distance criteria, planting <br /> details, protection of existing trees during construction, and proximity to intersections, driveways, street lights, <br /> and utilities. <br /> 3. The policy will apply to all new improvements being constructed in public r/w. <br /> - Processes are already in place for review of construction plans, location of utilities and easements, <br /> and issuance of permits for both publicly and privately constructed public improvements. <br /> — Review of tree location issues in individual building permit applications (infills) adjoining improved r/w <br /> would require additional staff for research of existing conditions, and resolution of problems and <br /> disputes. <br /> — Planting of trees in infill situations or along private streets could be encouraged. <br /> 3a. Special case: Would we include in our sidewalk projects? <br /> 4. The burden will be placed on the developer or builder to ensure that trees will be planted and maintained. It's <br /> counter - productive to plant trees until the adjoining property is developed. <br /> — Planting may be bonded, although bonds will likely be very difficult or impossible to obtain. <br /> — City may provide a list of suitable contractors or arborists, and accept a contract between the <br /> developer and arborist. <br /> - City may offer to contract for the installation and care of the trees for 2 -3 years, with a fee that fully <br /> covers all expenses. <br /> - Street tree plan would be required as an addendum to construction plans rather than criteria for <br /> Planning (Ch 9) approval. <br /> — Maintenance responsibility for street trees could be a standard requirement for CC &R's. <br /> 4a. City has insufficient staff to monitor and enforce the planting beyond the building permit stage. <br /> 5. Trees will be included on city capital projects when practical; maintenance will be City responsibility. <br /> — Are trees an assessable cost? <br /> 6. Preferred street tree location is in planting strip, between curb and sidewalk. <br /> — Setback sidewalks will be default position; complies w /ADA requirements. <br /> — May be in conflict with desire for smaller lots and more dense development; may conflict with solar <br /> requirements. <br /> 7. Implementation will require additional staff. <br /> — Staff will need to review street tree plan; any differences of opinion will need to be negotiated. <br /> - Some areas may not be suitable for trees: Rock, or Poor soil conditions, cut/fill slopes for roadways. <br /> Variances, waivers, problem resolutionaltemate locations, etc all need staff time. <br /> — If planting is part of building permit process, who will review plans for conformance w /approved <br />
