Pursuant to the provisions of Sections 2.019 and 6.305 . of the Eugene Code, 1971, <br /> I intend to amend Sections R- 6.305 -A, R- 6.305 -B, and R- 6.305 -E of Tree Preservation <br /> Administrative Rule R- 6.305, adopted by the City Manager on April 19, 1994, by Administrative <br /> Order 58- 94 -05 -P. <br /> B. On August 5, 1996, Ordinance No. 20056 was passed by the City Council and <br /> approved by the Mayor, which revised provisions of the Eugene Code, 1971, relating to tree <br /> preservation. Sections R- 6.305 -A and R- 6.305 -B of the currently effective Tree Preservation <br /> Rules should therefore be amended to address these changes concerning street and heritage trees <br /> and Section R- 6.305 -E should be amended to clarify the timeframe for expiration of permits, as <br /> set forth herein and in the Notice of Intended Rulemaking attached as Exhibit A hereto. <br /> C. The amendments to the Tree Preservation Rules as proposed herein will ensure that <br /> the Rules are in compliance with newly enacted provisions of the Eugene Code, 1971. <br /> Therefore, based upon the above findings, and pursuant to the authority of Sections 2.019 <br /> of the Eugene Code, 1971, the City Manager Pro Tem proposes to: <br /> 1.. Amend the definitions in Section R- 6.305 -A by adding in alphabetical order the <br /> following definitions thereto: <br /> R- 6.305 -A DEFINITIONS. <br /> As used herein, the following words and phrases mean: <br /> Heritage trek. Any tree defined in Section 15.2 of the Urban Forest Management <br /> Plan as adopted by the Eugene City Council on October 14, 1992. <br /> Street tree. A living, standing woody plant typically having a single trunk at least <br /> 1 -1/2 inches in diameter at a point six inches above mean ground level at the base of the <br /> trunk, that is located within the street right -of -way. <br /> 2.
