CB-14 2,3 <br /> of the <br /> City Manager Pro Tem of the City of Eugene <br /> PROPOSED STREET TREE PROGRAM <br /> ADMINISTRATIVE RULE R -7.280 <br /> The City Manager Pro Tem of the City of Eugene finds that: <br /> A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt <br /> rules for implementation of any provisions of that Code. In addition to that authority, Section <br /> 7.280 establishing policies, standards and procedures for the City's Street Tree Program was <br /> added to the Eugene Code, 1971, by Ordinance No. 20056 passed by the City Council and <br /> approved by the Mayor on August 5, 1996. <br /> B. Pursuant to the provisions of Sections 2.019 and 7.280 of the Eugene Code, 1971, <br /> which specifically authorize the City Manager to adopt rules for implementation of the City's <br /> Street Tree Program, 1 intend to adopt the Street Tree Program Administrative Rule R -7.280 as <br /> proposed herein. <br /> C. Adoption of the Street Tree Program Administrative Rule R -7.280 as proposed <br /> herein is necessary to ensure that the City's Street Trec Program is implemented in a manner that <br /> is in compliance with the newly adopted provisions of the Eugene Code, 1971_ <br /> Therefore, based upon the above findings, and pursuant to the authority of Sections 2.019 <br /> and 7.280 of the Eugene Code, 1971, I propose to adopt the following Street Tree Program <br /> Administrative Rule R -7.280 to provide: <br /> PROPOSED STREET TREE PROGRAM <br /> ADMINISTRATIVE RULE R -7.280 <br /> R - 7.280 - Street Tree Program - Policy. <br /> In order to create attractive and healthy neighborhood environments no approval shall be <br /> granted for a development that involves the creation of a street unless the applicant has submitted <br /> and received approval of a Street Tree Plan pursuant to R- 7.280 -B.1 or executed an agreement <br /> with, the City pursuant to R-7.280-B.2 that ensures street trees will be planted and established in <br /> accordance with the standards and procedures provided for in these rules and the adopted policies <br /> of the Urban Forest Management Plan.
