Hammitt, Bob
From: Medlin, Johnny
T Norris, Linda
Cc: Andersen, Chris; Hammitt, Bob; Klein, Glenn (RIS1)
Subject: Hunter /Bardwell Tree Removal on Old Dillard
Date: Tuesday, February 01, 1994 2:36PM
Hi Linda,
Jens came back 50/50 with what he earlier stated that was likely.
a. He is recommending we lift the stop work order since he finds no legal argument that supports us to do
otherwise. Due to the possibility that we are open to being sued if we don't move on this, I'm going to contact
Doug Appel and tell them that we are preparing the paperwork to lift the stop work order. I will tell him that we
will get a letter out to him today that states we need a couple of days to notify the neighbors that the stop work is
being lifted and that he can begin operations under the permit again on February 7th.
b. He did find that the approval of the PUD can be tied to a successful resolution of the tree removal issue due
to language, not in the code, but in the south hills study.
This puts us back to needing a decision on what of the three ways of assessing penalty we wish them to pursue.
Admin. Civil Penalty or Muni Court or State Court..
Thanks
Johnny
Page 1
