d <br /> EUGENE= Public Works <br /> \ Maintenance <br /> 1820 Roosevelt Boulevard <br /> Eugene, Oregon 97402 <br /> (503) 687 -5220 <br /> September 24, 1993 <br /> TO: Lane County Board of County Commissioners <br /> FROM: Jan Staszewski, Eugene Urban Foreste <br /> SUBJECT: Comparison Between The County Tree Conservation and Protection <br /> Code, The New 'Eugene Tree Preservation Code, and the Previous <br /> Eugene Tree Preservation Code. <br /> Attached is a summary chart highlighting the major differences between the <br /> County and the new and previous City tree protection codes. While the chart <br /> compares the codes section by section, the real difference between the <br /> County's and the City's code is based on the philosophical intent of each <br /> code. <br /> The County's code was written to accommodate agricultural /forestry operations <br /> as an accepted primary use of the land and provided detailed provisions for <br /> environmental protection while still allowing that use. The City's previous <br /> code also allowed large scale commercial felling operations and didn't include <br /> many of these environmental protections and restrictions. <br /> The major difference in the new City code is that it specifically does not <br /> recognize agricultural /forestry operations as an accepted primary use of land <br /> within the city limits. Lands within the city limits primary purpose is <br /> assumed to be for urban development. Any large scale tree removal must be <br /> part of an approved development plan with emphasis on preserving the forested <br /> appearance of the site. <br /> Since the City code only applies to those areas within the city limits we <br /> don't anticipate this change having any impact on our ability to administer or <br /> issue permits under the County code in the Urban Transition area. <br /> For more information please contact me at 687 -5359.
