CD -M ^ Motorcraft
Dew, ISTRIBUTING INC
301 W. 5th P.O. Box 586 Eugene, Oregon 97440 (503) 485 -2906
1 -800- 452 -2613
June 16, •1993
City of Eugene
Adrian Stansfeld
1820 Roosevelt Blvd.
Eugene, OR 97401
Dear Mr. Stansfeld:
As per our conversation on June 15, 1993 regarding the maple
trees in front of Fortuna Distributing, Inc. on 5th and Lincoln
and the damage the roots are causing to the sidewalk in front
of the building. You said that the tree maintance crew will be
here next week to trim all the dead wood and cut the limbs
over our building and some of them overhanging the street. This
still does not alleviate the problem of dead limbs falling on
pedestrians or passing vehicles during a wind storm. We feel
that a Tree Doctor should be present during the trimming to
determine the health of the trees.
The roots of these old maple trees are raising up the side-
walk and causing it to crack. During the last big wind storm
a branch fell onto the street and could have seriously injured
a vehicle, pedestrian or a bicyclist. Since the roots of the
old maple trees are causing the damage to the sidewalk and the
city owns the property between the street and the sidewalk
where the trees are located, we feel that the city is responsible
for the maintance and any liability that may incur due to
the damage that the roots are causing to the sidewalk.
We would appreciate your consideration in this matter.
Sincerely,
Linda Allen
cc: Paul Schuberg
American Hardware Insurance
