ADMINISTRATIVE ORDER NO. <br /> of the <br /> City Manager Pro Tem of the City of Eugene <br /> CONCERNING NOTICE OF INTENDED STREET TREE PROGRAM FEES AND <br /> AMENDMENT OF THE TREE PRESERVATION FEE SCHEDULE ESTABLISHED BY <br /> ADMINISTRATIVE ORDER NO. 58- 93 -20 -F <br /> The City Manager Pro Tem of the City of Eugene finds as follows: <br /> A. Pursuant to the provisions of Sections 2.020 and 6.300 to 6.330 of the Eugene <br /> Code, 1971, on February 25, 1994, the City Manager issued Administrative Order No. 58-93-20 - <br /> F establishing tree preservation permit and appeal fees as set forth therein. The process currently <br /> being utilized for appeals has resulted in a reduction of cost to the City and the appeal fee should <br /> therefore be reduced to $500.00. <br /> B. Section 7.280 of the Eugene Code, 1971, which was recently added to that Code, <br /> authorizes the City Manager to establish fees for implementation of the City's street tree program. <br /> It would be more efficient to consolidate those fees with the previously established tree <br /> preservation fees in one schedule. <br /> C. I find that the reduction in the tree preservation appeal fee and the proposed street <br /> tree program fees set forth in Exhibit A hereto are consistent with applicable policies and <br /> directives of the City Council, including policies developed through the Eugene Decisions process, <br /> are based on the City's estimate of the costs associated with providing the services, and are <br /> necessary in order to recover those costs from the beneficiaries of the services. <br /> On the basis of these findings, I order that: <br /> 1. Copies of the Notice be provided to the Mayor and City Councilors, posted at two <br /> locations at City Hall, be made available for interested persons at the offices of the City Manager, <br /> 777 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m. to 5:00 p.m., <br /> Monday through Friday, exclusive of holidays), and published in the Register Guard, a newspaper <br /> of general circulation within the City. <br /> 2. All persons desiring to comment thereon shall submit written comments as set forth <br /> in the Notice.
