• <br /> In addition to the new street trees above, the housing developer intends to provide trees on the <br /> podium in the courtyard areas to replace the loss of canopy. A specific landscape plan has not <br /> been developed. <br /> FINDINGS: <br /> Both the Eugene Code section 6.305(3) and the Urban Forestry Management Plan Policy #15 <br /> provide for the removal of a street tree or heritage tree where it is necessary for the public <br /> health, safety, or welfare. The following findings support the removal of the trees as <br /> necessary for the public welfare: <br /> 1) The 1968 Urban Renewal Plan for the Central Eugene project designated this site as a <br /> location for a parking facility. <br /> 2) The site is designated as a development site in the 1990 voter - approved update of the 1968 <br /> Urban Renewal Plan. <br /> 3) The development site is zoned C -3 which provides for the most intense use by allowing <br /> development from property line to property line. <br /> 4) Upon recommendation by a Council approved citizen advisory committee, the conceptual <br /> design of the proposed mixed -use project was approved by the City Council in 1996. <br /> 5) The proposed project addresses goals and policies for dense development in the core area <br /> to promote compact urban growth and support for alternative transportation modes on a <br /> designated transit route. <br /> 6) The proposed project addresses goals and polices for housing in the downtown core area. <br /> 7) The proposed project addresses goals and policies through the Central Area Transportation <br /> Study to provide for adequate parking in the west end of the downtown area. <br /> 8) The proposed project is designed to be compatible with and sensitive to the adjacent <br /> neighborhood area. <br /> 9) A street tree mitigation plan will be developed as part of the project. <br /> 10) The situation of the impacted heritage trees at the development site was acknowledged by <br /> the Mayor and City Council at meeting on September 25, 1996. <br /> DECISION: <br /> A permit is hereby approved for the removal of the two heritage <br /> trees in the ROW and the three heritage trees affected by the <br /> proposed project, subject to the following conditions: <br /> Page -4- <br />
